The next major change to the VAT system will be the implementation of e fatoorah in Saudi Arabia, which will take effect on December 4, 2021.

    The purpose of this change is to streamline the invoicing process, improve VAT compliance, and boost tax collection in the Kingdom.

    Since April 2021, this e fatoorah law has been subject to public comment. Except for the start date of the second phase, which was originally slated for June 1, 2022, not much has changed.

    In Saudi Arabia, the e fatoorah mandate applies to standard tax bills (or standard invoices) and simplified tax invoices (or simplified invoices), as well as the debit and credit notes connected with each of these two bill types.

    For B2B and B2G invoices, regular tax invoices are utilized

    In B2C transactions, simplified tax invoices are used.

    Anyone residing in Saudi Arabia for VAT reasons must create electronic invoices for domestic transactions, according to the law. 

    The first phase is the generation pase

    The first phase of the e fatoorah in Saudi Arabia legislation takes effect on December 4, 2021. There will be no central e fatoorah platform for the time being. Instead, suppliers are expected to transition away from handwritten invoices and paper storage, as well as prepare for Phase 2.

    VAT-registered taxpayers must complete phase 1 of the process.

    Using an appropriate e fatoorah technology, create invoices in an electronic format. This system can be used on-premises, in the cloud, or in a hybrid mode to keep electronic invoices and transmit a copy to the buyer.

    There are no precise requirements for the e fatoorah format during this phase, as long as the content meets the standards of the standard or simplified invoice. For example, simplified invoices must include a Quick Response code (QR code) issued by the electronic e fatoorah system. Consumers can use their mobile phones to scan pertinent invoice data using QR codes.

    If you're just getting started with electronic invoicing in Saudi Arabia, it's a good idea to start with one of the formats that will be required in Phase 2.

    The second step is the integration phase

    Your e fatoorah in Saudi Arabia must be integrated with ZATCA's new, central e fatoorah platform for Continuous Transaction Controls during the integration phase (CTC). From January 1, 2023, there will be a staggered start. Each stage will be announced six months in advance to taxpayers who may be affected.

    Phase 2 and onwards

    Invoices must be sent in one of two formats.

    Saudi Arabian XML invoice based on UBL 2.1 syntax and EN 16931 invoice definitions, but with Saudi Arabian criteria limited.

    An embedded Saudi Arabian XML invoice is incorporated in a PDF/A-3 invoice file.

    In summary

    Saudi Arabia is following the global trend of requiring mandatory CTC e fatoorah and e-reporting. By 2023, it will launch a new clearance platform. E-invoices must be generated and stored electronically through compliant e fatoorah in Saudi Arabia systems during the initial preparation phase, which begins on December 4, 2021.

    From January 1, 2023, the second stage will be implemented. The new central e fatoorah platform will become required for real-time e fatoorah clearance and e-reporting during this phase.

    Hash: This will ensure that the sequential numbering is used, and that there is no intervention (such a replacement or deletion) apart from the individual numbering that the taxpayer uses. This element will not contain the invoice data, but it will be used to prevent any modifications of the document. The next invoice will use the hash of that particular invoice. It will be calculated from all elements of the previous invoice (UBL bill, hash, previous invoice, QR code and cryptographic stamp).

    QR code: This allows for quick and simple verification of the document using QR camera scanners. It will be encoded using Base64 format, with up to 500 characters.

    Counter for internal documents: An independent counting solution that cannot reset and allows for quick detection of fraudulent intervention.

    A key feature of the Compliant Solution the ability to connect to the Internet, and to integrate with other systems via an application programming interface (API), will be possible.     Technical functionalities (Annex 1)
