Hugh Guthrie’s Answer Indicates His Understanding of Situation Is That It Is ‘Preferred Class’ Penitentiary ---- HANSARD RECORDS OBJECTIVE SOUGHT BY SPECIAL VOTE --- (By WILLIAM MARCHINGTON) (Staff Correspondent of The Globe.) OTTAWA, June 9. - Members of Parliament learned with amazement that Toronto and Ottawa stock brokers sent to Kingston Penitentiary for ‘bucketing’ and other financial knavery which robbed clients of lifetime savings are not incarcerated behind prison walls, but are enjoying considerable freedom on the Collin’s Bay Farm, some miles wets of the City of Kingston.

    What Parliament Voted For. When Parliament two years ago voted $150,000 for the purchase of the farm lands and to begin erection of buildings, it was on the distinct understanding that the ‘preferred class’ penitentiary was for the purpose of accommodating ‘juvenile delinquents.’ and to segregate them from the hardened criminals and older offenders who are sentenced to Portsmouth Penitentiary. The Minister of Justice, Hon. Ernest Lapointe had been urging the Government for years to make an appropriation for a prison farm to which boys of 16, 17, and 18 years of age could be sent. It was never his intention that adults guilty of such serious offences as those for which the Toronto brokers were sent down should enjoy the privilege of farm life.

    The discussion in Parliament at the time the money was voted clearly shows what was in the mind of the Government and of members of the House. Members are now asking if the Collin’s Bay Farm is to be devoted to the reformation of juvenile delinquents, or whether it is to be a sort of country club for ‘preferred inmates,’ like the Toronto stock brokers. Others, more cynical, inquire if there is a golf course on the property, and whether a stock market ticker has been installed for the convenience of the convicted brokers.

    Questions Asked The Globe’s story about life on the farm and the preferred treatment extended to the erring stock brokers, published in Monday’s issue, was today brought to the attention of Parliament by James S. Wordsworth, Labor member for Winnipeg North Centre. Mr. Woodsworth asked the following question:

    ‘Two years ago quite a large sum of money was voted by the House for the establishment of a special farm near Kingston for juvenile delinquents. According to a report in yesterday's Toronto Globe the convicted stock brokers are now enjoying life on that farm in a sort of open-air camp. The articles goes on to say: ‘Men  sent down for defrauding clients of millions are preferred inmates, work on smiling farm lands, are housed in construction camp buildings, and the whole area is enclosed by a fence to keep the public out.’ ‘Guards carry no arms - balanced rations and music in the evenings,’ and so on. I would like to ask the Minister of Justice whether special treatment is being given to these stock brokers or whether this article is a mere fabrication.’

    To Make Answer Today. Hon. Hugh Guthrie, Minister of Justice, replied: ‘I may say that the farm in question is not for juvenile delinquents. It is called a ‘preferred class penitentiary. I have no knowledge whatever as to where the stock brokers referred to have been incarcerated. I shall make inquiries and report tomorrow to the honorable member.’

    That the former Minister of Justice and Parliament intended the farm at Collin’s Bay to cope with the problem of juvenile delinquency is clearly shown by the discussion in 1928 and 1929 when the money was voted for the purchase of the farm and the erection of suitable buildings. The matter was raised on June 9, 1928, by General Ross, Conservative member for Kingston. ‘It is terrible,’ said General Ross, ‘when you think of the increase of delinquency among our boys. There must be some cause for it, and the Department of Justice and the Departments of the Attorneys-General in the Provinces should now take the matter up.’

    ‘What suggestion has my honorable friend to offer with regard to the method?’ asked Hon. Ernest Lapointe, Minister of Justice.

    ‘In the first place,’ replied General Ross, ‘I would advise the Minister that the time has come when he should put his foot down upon the present practice of sending boys to the penitentiary. There are today in the penitentiaries boys of 15, 16, and 17.’

    The Minister of Justice observed that ‘I am a strongly in sympathy with my honorable friend in connection with the reform he suggests having to do with young offenders, and I have already stated in this House that I do not think it fair to put young people 16, 17, and 18 years of age in continuous contact with hard-boiled criminals. They are not given a chance to reform, and I thank my honorable friend for having spoken on this matter today. When the estimates are being prepared next year this will help me to convince my colleagues that the money will be well spent to provide for the construction of special institutions for young offenders. We should segregate those young people and give them a chance to reform. This will mean quite an expenditure of money, but I think we owe it to our young people that this money should be spent.’

    Collin’s Bay Site Vote One year later, on June 12, 1929, Mr. Lapointe asked Parliament to vote $150,000 for the purchase of the Collin’s Bay site and to begin the erection of buildings. The ultimate cost, he said, might be $200,000 or $300,000.

    Members of Parliament are recalling the circumstances in connection with the arrest of the stock brokers. Evidence of irregularities and of violations of the law was discovered by Federal sales tax auditors going over their books. Hon. W. D. Euler, Minister of National Revenue, passed the information on to the Minister of Justice, Hon. Ernest Lapointe. As prosecution was a matter for the Provincial Attorney-General Mr. Lapointe relayed the evidence to Hon. William H. Price. One Toronto stock broker was dramatically arrested on evening a couple of hours before W. E. N. Sinclair, Liberal Leader in Ontario, and S. C. Tweed, Liberal member of the Legislature for North Waterloo, made sensational disclosures concerning Toronto mining exchange frauds, in speeches at Waterloo. Mr. Price supposedly got wind of the pending revelations, and forestalled the effect of the speeches by making the arrest. Nine days later eight or nine others were arrested.
