GSTIN not mandatory for MSME registration

Micro, Small, and Medium Enterprises (MSMEs) should register with the Government Udyam registration system. The government has made it much easier for MSMEs to register on this platform. The registration site intends to provide single-page registration, minimise processes, and save time when registering any MSME.

Previously, GSTIN (GST Identification Number) was required for MSME registration on the Udyam registration platform.

However, the government has received multiple concerns from various MSME Associations claiming that the required requirement of GSTIN is interfering with the MSME registration process. Many businesses are excused from filing GST Returns as required by the GST Act or notification.

Now, entrepreneurs and proprietors who are excluded from filing GST returns can establish their company as an MSME on the Udyam Registration platform using only a PAN card and no GSTIN.

This facilitation would make it easier for various micro-firms, such as skilled craftsmen, artisans, and other enterprises in the informal and unorganised sectors, to register.

    PATENT RULES IN INDIA

A device, method, composition, or procedure that is original or novel is considered an innovation. The government grants a patent for any innovation that is novel, non-tangible, and valuable in terms of contemporary application.

Simply put, a patent is an exclusive right bestowed by a government on the creator of innovation for a limited period of time. This privilege prevents others from making, indulging, creating, utilizing, selling, or importing the invention without the creator’s approval.

It covers all innovations identified, whether a product or a procedure, that is novel and inventive including extraordinary, unmistakable, creative measures that have business application.

There are three basic parameters for an invention to be patentable, which are:

The invention must be novel, which means it must not already be in existence

The invention must be non-obvious, which means that even a person who is well-versed in the area to which the invention pertains might not be able to come up with that invention without exerting or acquiring exceptional mental skills and ability

Further, the invention must be beneficial to mankind and have a reasonable purpose. A useless or illegal innovation is not eligible to be patented.

Benefits of Filing a Patent in India

Certain benefits of filing a patent in India are as follows:

Enjoy increased credibility as the owner of the innovation

Gain legal monopoly over the innovation

Additionally, restrict your competitors from copying, selling, or importing your intellectual property without prior permission

Obtain an additional source of revenue, as patents can be sold or licensed

Profit from premium valuation as patented products attract buyers who are willing to pay more on account of restricted availability.

What Is not Patentable in India?

As per Sections 3 and 4 of the Indian Patent Act, the following innovations are not patentable in India:

     1. An invention that is frivolous or trivial.

    2. An invention that claims anything obviously contrary to well established natural laws.

    3. The mere discovery of a scientific principle.

    4. Moreover, an invention whose primary goal or intended use is contrary to law or morality or is injurious to public health.

5.The formulation of an abstract theory.

    6. Further, the mere discovery of a new form of a known substance, which does not result in the enhancement of the known efficacy of that substance.

7.The mere discovery of any new property or new use for a known substance or of the mere use of a known process, machine, or apparatus, unless such known process results in a new product or employs at least one new reactant.

    8. A substance obtained by a mere admixture resulting only in the aggregation of the properties of the components thereof or a process for producing such substance.

Similarly, the mere arrangement or rearrangement or duplication of known devices, each functioning independently of one another in a known way:

    1. A method of agriculture or horticulture.

    2. Some more innovations that are not patentable in India.

    3. Inventions relating to atomic energy.

    4. Any process for the medicinal, surgical, curative, prophylactic, or any other          type of treatment of people or animals or other creatures.

    5. Plants and animals in whole or any part thereof other than microorganisms          but including seeds, varieties, and species and essentially biological              processes for production or propagation of plants and animals.

    6. A mathematical or business method or a computer programme per se or algorithms.

    7. Likewise, a literary, dramatic, musical, or artistic work or any other aesthetic creation whatsoever including cinematographic works and television productions.

    8. Similarly, a mere scheme or rule or method of performing a mental act or method of playing a game.

    9. Presentation of information.

    10.Topography of integrated circuits.

    11. An invention which in effect is traditional knowledge or is based on the     properties of traditional knowledge.

    Disclaimer:

The information in this article reconciles general information on what is not patentable in India. Further, for a more complete understanding of what is and what isn’t patentable, you can get expert’s help from Tax Salah.

To get a better idea about whether your invention is patentable or not get in touch with our experts right away.

Validity of a patent filed in India:

Every Patent in India is valid for 20 years from the date of filing for the patent. However, the term of 20 years commences from the international filing date for those applications filed under the Patent Cooperative Treaty (PCT).

MENTION THE PATENT RENEWAL FEE FOR PATENT HOLDERS HERE.

In the event of non-renewal, the patent expires and becomes part of the public domain. This means that a patent holder cannot sue a third party who takes undue advantage of the patent after the renewal deadline.

However, there are ways in which a patent can be salvaged even after the renewal deadline. You do so by either requesting a six-month extension on paying a late fee or filing for the restoration of the lapsed patent.

Either way, both these routes require extensive legal expertise and professional knowledge. If you need help restoring an expired patent, get in touch with us right away.

New GST Registration - Important Tips to Follow

New GST registration Goods and Services Tax or GST is a type of indirect taxes imposed by the government in the Republic of India. Goods and Services Tax, as it is commonly known by the Indians, is a form of tax that is raised on the production of items by the manufacturing company and subsequently distributed to the end users. It also includes all the people or organizations that provide services and goods to the country. The basic purpose of Goods and Services Tax is to make the production and distribution of goods in the country easy by taxing the income derived from such activities and then distributing it amongst the various entities.

The procedure of gaining the goods and services tax is very simple. Basically there are three places where you can gain the goods and services tax allowance; the online route, the real estate route and the principal place of business. The online route is the easiest one as you do not have to personally visit the office of the customs at the point of entry. All you have to do is log onto the web portal of the customs and fill the online form with the necessary information required and submit the same. Within a few hours, you will be notified about your gain.

On the other hand in the case of Real Estate, if you wish to gain the goods and services tax allowance, you can seek the help of an agent who will act as your representative and help you gain the goods and services tax through the inspection of the property. The real estate agent's fee is generally computed based on the amount of the gain which he will be fetching from the inspection. In case of the principal place of business, all you have to do is obtain the copy of the register of business and go to the designated place of business and then submit the copy of the register of business. You will receive a copy of your gain as per the prescribed rate of Goods and Services Tax.

5 THINGS YOU NEED TO KNOW BEFORE STARTING BUSINESS RELATED TO FASHION INDUSTRY

5 Things to Know About the Fashion Industry Business:

    1.   Know Your Target Audience:

Fashion start-ups tend to fail because they do not take the time to get to know their customers. Not everyone prefers the same looks or has the same taste in fashion. To identify the ideal placement for your company in the market, test your fashion products and the message you wish to convey. It's essential to choose the right customer base so that your brand can focus on serving a niche, instead of every customer in the marketplace.

Don't underestimate the importance of knowing your target audience and identifying a niche just because it seems like it won't lead to the generation of profit. This step is crucial for long term survival in the fashion marketplace because it is only through customer research that you will be able to discover a blind spot that requires supply and complements your vision.

    2.   Focus on Nailing That Logo Design:

Branding is everything and a good logo is an absolute game-changer when it comes to the fashion industry. People will judge your brand and make decisions on whether or not they want to purchase from your collection based on their initial impressions. So, get your logo right the first time. Your brand logo must not only have the ability to instantly connect with your customers; but it should also be able to accurately convey the tone of your business, its message, style, and who you are as a designer. Nevertheless, we understand how difficult it can be to come up with an eye-catching logo that can be trademarked, this is exactly why we recommend engaging professional help.

    3.   Careful Curation Is Better Than an Extensive Collection:

In the words of Ananth Narayanan, CEO of Myntra, 'Personalization and curation based on personal taste will become a lot more important.

It's not about having the most options; it's about presenting the best options to the customer'. Gone are the days when Indians equated greater quantity with higher customer satisfaction. More and more people are looking for quality pieces that align with their sense of self rather than an extensive range of products.

    4.   Take Your Ideas Digital: E-Commerce Is the Way to Go:

E-commerce is all the buzz. Everything from fashion industry careers to fashion industry news is moving digital, and the pandemic has only accelerated the transition. The e-commerce fashion industry is going to be the next multi-bagger and we can't say that we didn't see it coming. The success stories of fashion powerhouses like Myntra, Shein, Urbanic, and Ajio to name a few are unprecedented and inspiring. If you wish to succeed as a fashion industry company and become the next big name in fashion, let us take your business online.

    5.   Fashion Industry Pollution:

Need for Sustainable and Eco-friendly Practices. The apparel business accounts for 10% of global carbon emissions and is the world's second largest water consumer. The situation is so bad that the fashion industry has become synonymous with pollution. Even fast-fashion brands like Zara and H&M, have realized the importance of embracing sustainable and ecofriendly manufacturing processes. In such a climate, it is important for new and upcoming fashion start-ups to strictly adhere to the fashion industry's sustainability standards.

    The Takeaway:

The world of fashion is an exciting and lucrative industry. While chasing your dreams of launching a ground-breaking fashion start-up remember to remain true to your brand's identity and message. If you succeed in remaining true to your story, fame and success will follow.
