  • The Supreme Court agreed on Monday to take up a case brought by various groups and state and local officials challenging a Trump-era rule that makes it more difficult for immigrants to obtain legal status if they use public benefits, such as Medicaid, food stamps and housing vouchers.

    The rule, issued by the Trump administration in August 2019, is still in effect in most states nationwide. It immediately met pushback, and was subsequently blocked by courts, following its release.

    I subscribe to Taiye Selasi’s approach to defining one’s background through one’s experiences. Growing up, I, too, faced a similar dilemma as nationality has proven to be distinctly perplexing for my brother and me. I was born in the States but moved to India at the age of 3. Although India is as homely as it gets, I have spent most of my life here on a visa. Visiting the embassy every few years or so acted as a stark reminder of my foreignness in my own home. Only recently, on turning 18, I was granted overseas citizenship, which bars me from contributing to this democracy (no right to vote) but allows me to reap its benefits. My brother, on the other hand, spent most of his childhood in the States, after which he briefly returned to India with me before returning back for college at Cornell. He has been in the States ever since. When he first returned to India, he experienced the same set of challenges and successes that I expect when I get to America. It is a fact that even though he’s more American than I’ll ever be, yet, he is nothing but an immigrant in my home country. Like Selasi’s, I’m often questioned by my friends about my Indianness since I’ve never experienced pursuing The Great Indian Dream as an immigrant in the States. With the recent changes in the H1B immigration policy, it gets nothing but harder for the likes of my brother to stay in the country that he has committed to since childhood. As pointed out by Selasi, it is truly a dilemma that constructs such as the government dictates the rights to live amongst who they deem their ‘locals.’ Although other countries may have to face a complex challenge of quantitatively defining a person’s 'localness’ to a country, America is clearly the exception. The United States is one of the few countries that is quite literally a country of immigrants, with significant economic sectors being run solely by immigrants. Therefore, I find a great deal of irony in their coldness to foreign nationals looking to become a part of the greatest country in the world.
