Capital Gains Tax Increase Could Hurt Home Sellers In Hot Markets| Investor's Business Daily
President Biden’s proposed near doubling to 39.6% of the top long-term capital gains tax rate could wallop certain homeowners.
The tax boost is supposedly intended to be aimed at just millionaire and billionaires — taxpayers with more than $1 million of income.
But it could unintentionally impact middle-income homeowners as well, say personal finance experts.
Here’s how: Huge run-ups in home prices in many markets could lift the income of many middle-income homeowners. It’s a risk to those who sell their residences above the $1 million threshold. And talk about bad timing. This might happen as many downsize for retirement.
Capital Gains Tax: Higher Rate, Worst Time
That could make them subject to the 39.6% capital gains rate just as they near the moment when they will lose much of their earning potential and just as they are looking for one final way to pump up the nest egg that will provide the bulk of their retirement income.
Nationwide, the number of homeowners whose homes have soared in value by more than $1 million is small. As of a year and a half ago when he crunched the numbers, “the people who bought at the trough of the market, eight or nine years ago and had since sold for a gain of over $1 million was maybe less than 1%,” said Sheharyar Bokhari, an economist for real estate brokerage Redfin (RDFN).
Similarly, people who still own homes that have appreciated in value by more than $1 million is also less than 1%, Bokhari says.
Hot Markets Hit Hardest
But in hot markets, that impact is magnified, Bokhari says. “In places like San Jose (California’s Silicon Valley), Los Angeles, Seattle, New York, San Francisco, there are lots of really expensive homes,” Bokhari said. “Probably Boston too, especially those people who bought in (at market lows) after the financial crisis. We’ve seen a lot of home-price appreciation.”
Some Gains Left Out
Still, some existing rules that exclude a portion of gains from income calculations shield some home sellers from the proposed new top capital gains tax rate.
That current law lets you exclude up to $250,000 of that gain from your income, says Tim Speiss, partner in EisnerAmper’s Personal Wealth Advisory Group, who follows tax legislation. Married joint filers can exclude up to $500,000. So far, Biden has not proposed changing those exclusions, Speiss says.
So you would not trigger the $1 million threshold for the new higher cap gains rate unless your net income, after those exclusions, topped $1 million.
Hot Markets Most Vulnerable To Capital Gains Tax
Generally, that’s more likely to occur only in those hottest housing markets, says Lawrence Yun, chief economist for the National Association of Realtors.
“A good number of homeowners will be insulated from the proposed higher capital gains tax rate because those allowances (of $250,000 and $500,000) are quite sizable,” Yun said. “But in recent years, we’ve had prices rise significantly, so high-cost areas like (Seattle) Washington and L.A., where housing has been super hot for multiple, consecutive years, people will potentially see the new potential capital gains tax on their home-sale gains.”
Where Home Sales Are Likeliest To Trigger Capital Gains Tax?
A home sale is most likely to trigger capital gains tax liability on high priced homes. Hot markets are where lots of homes are at nose-bleed heights.
How hot are some markets? The median value of homes is $1.39 million in metropolitan San Francisco, according to a recent Redfin report. And it is more than more than $1.2 million dollars in metro San Jose.
))Median values are more than $821,000 around Oakland, Calif., $768,000 in metro Anaheim, Calif. and $687,000 around Los Angeles. Median prices top $658,000 in metro San Diego and $619,000 in the Seattle area.
They exceed $582,000 in metro New York City, $516,000 in Nassau County on New York’s Long Island and $554,000 in the Boston area.
Higher Capital Gains Tax Could Slow Housing Rebound
Homeowners who fear they may be subject to the new, higher capital gains rate may decide not to sell, Yun says. That could fuel a growing housing shortage. And it could buoy prices for inventory that does go to market, he adds.
In turn, that could hamper the housing sector recovery, Yun says.
The long-term capital gains tax applies to stocks and bonds sold in 2021, for example, after being owned more than 12 months.
The current 20% rate applies to single filers whose yearly income is $445,851 or more. It applies to married joint filers whose income is $501,601 or more.

Ordinary income tax rates apply to capital gains on assets sold after being held in less than a year.
In addition to the 39.6% capital gains tax rate, taxpayers would be subject to the current 3.8% net investment income tax (NIIT), for a combined total of 43.4%.
The 3.8% surtax, which helps fund the Affordable Care Act, widely known as Obamacare, is also assessed in addition to today’s top rate of 20% for taxpayers whose income is high enough.
However, for homeowners, capital gain from the sale of a home is subject to the 3.8% surtax only if the home is rental property, Speiss says. In addition, net rental income itself is subject to the surtax.
Proposed Change To 1031 Exchanges
Biden has proposed changing another tax rule that could make more of a home owner’s profit on the same of a home vulnerable to capital gains tax. He says he wants Congress to eliminate a key part of what’s known as a 1031 exchange.
A 1031 exchange lets a property owner avoid capital gains tax and depreciation-recapture tax when he or she uses proceeds from the sale of a property to buy another within 180 days. Biden wants to eliminate that legal loop hole when the capital gain is more than $500,000.
Gains that are smaller would still be allowed to dodge cap-gains tax and depreciation-recapture tax.
The 1031 exchange rule involves lots of fine print. But some key provisions boil down to this: “1031 exchanges are not typically allowed for a primary residence though there are some exceptions,” Redfin’s Bokhari said. “One exception would be the owner of a multi-family property who lives in one unit and rents out the others as investments.”

I had my back turned to the gravel lot where customers parked, watering the plants on display and mixing up plant food when I heard the low purr of a motor. I stood up and turned around, mind screeching in surprise. The most handsome man I had ever seen was stepping out of a car. In my lot. "What in the name of Gay Jesus is happening right now?" I thought to myself as I brushed off my apron and adjusted my nametag, waiting to greet the customer. "Hello sir, welcome to The Raven's Nest! I'm Y/N, how can I help you today?"
"Nice to meet you Y/N; I'm Kuroo. I was wondering if... " He trailed off as he removed his sunglasses. "Oh!"
"Oh?" I asked him in response
"Its... erm... nothing."
If I wasn't mistaken, I saw a faint blush spread across his face.
"Well Kuroo, if you need anything I'll be inside the trailer mixing up plant food."
"Thanks! I'll be sure to let you know!" He said slyly, giving me a smile and a wink as he left to peruse the available selection of plants. Sliding into the trailer, where containers of herbs and chemicals sat behind jars on the table, I breathed out a sigh of longing, and the feelings of a new crush seeped into the walls of the trailer.
As I was browsing the selection, I kept thinking to myself of Y/N. His height, size, build, hair colour, and attitude were just perfect. He was exactly what I had been looking for in a long-term partner, and better yet, he was interested in me too. Whether he knew I was interested in him, though, was another question. Stopping occasionally to pick up a plant, pot, or watering can I liked, I began to formulate a plan for how I would ask him out.
Kuroo approached the old desk I kept outside as dual-purpose for potting plants and ringing up customers and dinged the old bell. I stepped out and noticing his armload of stuff, and I rushed over to relieve him of as much as possible. He seemed lost in thought, but as I got closer, he snapped back to reality and smiled at me.
"Hey cutie~." He said to me.
I froze dead in my tracks, a blush running rampant across my face.
"What? Did I fluster you already?" He asked, keeping up the sappy tone.
"N-no I just suddenly felt very warm...a-anyways, l-let me ring that up for you." I managed to stutter out, silently cursing myself for being embarrassing.
"Yes please~," Kuroo said, switching to a sultry tone.
I tried to hide my blush as I rang up his items and ran his card through my payment system.
"So," He breaks the silence, "would you like to come get a coffee with me some time? I know a cute place that I think you might like~,"
"S-sure, that w-would be nice," I said, still blushing furiously at him as I finalised the transaction. "Do you need help taking stuff out to your car?"
"From you? Always~"
I picked up a couple of plants and started walking out to his car, him following closely behind.
"When do you close? We could go now if you want. I'm free all afternoon." He says as we load plants into his trunk. "Then maybe you could help me get these babies set up in my new apartment."
I check my watch and decide that I could close early today. None of my regulars had called for help or gardening services, so my day was empty as well.
"Alright, I guess. But no funny business, mister!" I tell him, playfully wagging my finger.
I watched Y/N run back across the gravel lot to his shop, untying his apron from around his waist as he went. Suddenly, I thought of something. "Does he live in that trailer?" No, it's probably just for the shop. I make a mental note to ask him about the shop and his house later. "Not in a creepy way, Kuroo. You know what happened last time." I think to myself.
"Hey, Kuroo! I'm gonna drop my car off at my place, will you follow me?" Y/N shouts at me as he opens the door to his canary-yellow pickup, having locked up the gate to the shop. I give him a thumbs-up, and he climbs inside. I hear the engine crank and splutter to life, and he pulls past me down to the two-lane road that connects the countryside to the highway. Instead of turning left towards the city, he turns right and begins travelling up the road, deeper into the country. Suddenly, after about a mile, he stops and turns onto a dirt road obscured by lush green trees. We putter along this road for a while, a serene crook running beside the road before coming to rest in a bit of pond teeming with life, and the forest opens up onto a clearing framed by a log arch. Inside the clearing is the perfect sight: a beautiful old farmhouse covered in ivy, plants growing awry in every nook and cranny. It's gorgeous and suits someone like him.
As I climb out of my pickup, the smell of the woods hits me, and I am home again. Kuroo parks his sedan next to my truck and gets out, staring up and marvelling at the sight.
"Can we stay here instead of going out?" He asks with a look of pure amazement still on his face.
"Sure! I'll get us some Butterfly Pea flower tea. Come and we can sit on the veranda."
As I prepare the tea, I begin to wonder: "What if he thinks I'm a creep who's lured him out into the middle of the woods to kill him! Oh no, quick, what can I do so I don't look like a creep? Agh, and I look fat! It's that leftover pasta from lunch, isn't it? Damn it, I lost my only chance to make a good first impression."
And with that, I grab the teas, push open the worn-out screen door that creaks, and promptly fall right into him.

Emily Carroll is a master of horror illustration and graphic novels. Go check out her website here, where she has some illustrations and short webcomics up that’ll give you a great idea of her work. I read His Face All Read, which is included in this collection, and immediately wanted more. Her work is so moody and mysterious and interesting and I love it.
Unlike most collections I talk about, I’m gonna give a short reaction to every single one of these comics let’s go let’s gooooooo!
Our Neighbour’s House is the first main story of this collection, about three girls whose father disappears and are visited by a stranger. What I like about this one is that, even in the limited format, the three sisters feel very real and well-characterised. The use of colour in this story is striking - it’s very muted, the almost monochrome cabin contrasted with the dull colours of the girls’ faces and clothes. It creates a very bleak, washed-out landscape that seems to brim with terror. One thing I love about Carroll’s writing in general is how ambiguous it all is - rarely are there easy answers or neat conclusions, and this one in particular is chilling.
A Lady’s Hands Are Cold is about a woman who marries a wealthy man, and hears the song of his murdered first wife in the walls. It’s a pretty standard fairytale setup, very Bluebeard, but executed brilliantly. In contrast to the previous story, this one is all bold reds and blues, and the pale corpse-flesh of the first wife when she is found is so unnerving and creepy. It’s also a good example of using the fairytale structure to tell a surprising story - you might think that finding the murdered wife would be a good thing to do, proving the protagonist is a good-hearted heroine, but you would be deadly wrong.
His Face All Red is, as mentioned, one that you can go read for yourself right now! I love the subtleties of the relationship between the narrator and his brother, his obvious jealousies masked by short, factual statements that are dripping with scorn and envy. Carroll’s writing style tends towards these short but evocative statements that beautifully compliment her art, and it works so well for this type of horror.
My Friend Janna is about two young girls who fake séances, but seem to later be haunted by a real ghost. Again, the ambiguity in this one is key. Never do we learn the details of what’s going on, and it’s all the more chilling for it. The art is again almost monochrome but for the striking red, and it makes a horrific contrast.
The Nesting Place is the last full story, about a young woman named Bell who goes to live with her brother in the school holidays after her mother’s death, and her strange encounters with his fiancee. I feel like a broken record here, but this is some greatly effective horror. The nature of Carroll’s monsters is so weird and viscerally upsetting without being a mess of blood and bone for pure shock value. The art of the monster once it is revealed is genuinely horrifying in a way that can only really be captured through illustration. Bell, a moody and introverted teenager, is an interesting protagonist, and her interactions with Rebecca are chilling even before you realise what’s going on. And, once again, the ending is immensely satisfying while still be utterly creepy and horrific.
There are also shorts, labelled, An Introduction and In Conclusion at the start and the end of the book. An Introduction works to set the tone well, a creepy little mood-setter. In Conclusion is just perfect to send a chill up your spine as you finish the book. They’re both very effective and I love them.
Phew. That’s all for this time - next up, one of the most challenging books I’ve read so far this year.
